Then go call up CSX and tell them there are repaints here and if that's OK with them.

Papa, by the way your putting it, almost everything in the repaint section is essentialy illegal.

Ah, the grey zone.
The license says you can't use the railroad's trademarks without permission.
It is up to the railroad to make the repainter cease and desist, or else go to court and demonstrate damage, unlawful gain, etc., in the face of of fair use.

Will the railroad bother, taking into account costs and bad publicity?

The answer may be found in historical data: how many such cases have been brought to court?

I don't think anyone would ever be sued for a freeware reskin. Copyright laws pertain to products produced for profit.

Here is how I see it. You should be allowed to do it, but if you do VRC is loosing money. If you repaint conrail for free but the actual pack with conrail in it is $5, nobody spends $5 on a pack they can get it free. In realty, the pack is better and has more accurate details. Heres what I've done. I repainted a NS GP40. Im not releasing it, and im still buying the NS GP40 pack

Seems to me that it's a case of the old saying where you "Don't ask questions to which you may not want to hear the answer." But getting right down to the basics, I can't seem to envision somebody -- anybody -- saying "Aha! A freeware repaint of a Conrail locomotive for a train simulation! Let's call-out our lawyers and contest this!". -Jon

That is a very interesting comment. Let me add something to this. How about we have this super neat locomotive that everyone knows is super neat. How about I am in love with the xyz railroad. How about someone does a free re-paint for xyz railroad. You really like this paint job for xyz but you don't have the super neat locomotive? How do we solve this problem you ask? You go and buy super neat locomotive so you can have a use for this paint job.

Incorrect, because you should never include the Geopcdx file in the reskin folder, everyone has to buy the original model to use your reskin, so VRC makes lots and lots of money from people who want to use reskins, that's how this game has survived for the last 7 years, otherwise, we wouldn't play the game any more if we can't have reskins and all locomotives are blank, or, everyone of them is from the same Railroad, how boring would that be...... *!sad!*

Payware developers have had a great time over the years thanks to the army of reskinners, just think how many units they would have sold without any FREEWARE repaints being done.

Lots and lots of money? Where did you hear that we were getting a lot of money? What is your definition of "lots and lots of money"? You are presuming that we have been able to tap into the same market that RSC has, which we have not and can not. We are getting sales via word of mouth, forums, Face Book, and those who happen upon our website.
